This policy applies to the website www.kingsavenue.com and to our services generally. It is drafted in accordance with the Swiss Federal Act on Data Protection (FADP, revised version in force since 1 September 2023) and, where applicable, the EU General Data Protection Regulation (GDPR).

 

Personal data that we process

We process personal data that you provide to us — via our website, by e-mail, by telephone, via WhatsApp or other messaging services, by post, or in person — and data that arises from our contact with you. This includes:

A. Contact and identification data

  • Name
  • Postal address and country of residence
  • Telephone number
  • E-mail address

B. Enquiry and booking data

  • Your enquiry details (destination, dates, party size, preferences, budget indication)
  • Booking and contract details, including special requests relevant to your stay
  • Where required at contract stage: a copy of your passport or identity document, for identification and contractual purposes only

C. Contact history

  • What the contact was about, when it took place, with whom, and through which channel (website form, e-mail, telephone, WhatsApp, in person)

D. Website and technical data

  • Data collected through cookies and similar technologies when you visit our website (see “Cookies” below)

We do not deliberately collect special categories of sensitive personal data. Where you choose to share such information with us in the context of a stay (for example dietary or health-related requirements for your family), we treat it with strict confidentiality and use it solely to deliver the service you have requested.

 

Minors

Our website and services are not directed at persons under 16 years of age, and we do not intend to collect data about them without the consent of a parent or guardian. We cannot always verify a visitor’s age. If you believe we have collected personal data about a minor without such consent, please contact us at info@kingsavenue.com and we will delete this information.

 

Purposes and legal basis of processing

We process your personal data for the following purposes:

A. Handling your enquiry and performing our agreement with you
To respond to your enquiry, propose suitable chalets, conclude and execute a rental or service agreement, and keep your details up to date in our administration.
Legal basis: performance of a contract, or steps taken at your request prior to entering into a contract (Art. 6(1)(b) GDPR).

B. Client relationship and communication
To stay in contact with you as a client, including occasional updates on chalets and availability we believe are genuinely relevant to you.
Legal basis: our legitimate interest in maintaining client relationships (Art. 6(1)(f) GDPR), or your consent where required. You may object or unsubscribe at any time.

C. Newsletter
If you have subscribed to our newsletter, we use your e-mail address to send it. Every newsletter contains an unsubscribe link.
Legal basis: your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time.

D. Legal obligations
To comply with legal obligations, including accounting and record-keeping requirements under Swiss law, and to prevent fraud.
Legal basis: compliance with legal obligations (Art. 6(1)(c) GDPR); our legitimate interest in preventing fraud.

E. Security and quality
To secure our website and IT systems, protect you and us against misuse and crime, and review the quality and lawfulness of our own processes.
Legal basis: our legitimate interests (Art. 6(1)(f) GDPR).

 

Automated decision-making

Kings Avenue does not make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you. Every enquiry and every booking is handled personally.

 

Systems and service providers we use

To operate our business we use carefully selected service providers (“processors”) who may process personal data on our behalf, under data processing agreements:

  • Microsoft — customer relationship management (Microsoft Dynamics 365) and e-mail / office environment (Microsoft 365), hosted in data centres within the EU
  • Intuit Mailchimp — newsletter distribution
  • Google — website analytics (Google Analytics), advertising (Google Ads) and tag management, subject to your cookie consent
  • Our web agency and hosting provider — operation, maintenance and content delivery of www.kingsavenue.com

In addition, where necessary to deliver the holiday you have booked, we share relevant details with the chalet owner or operator and with local service partners (for example transfers, ski services or spa services), always limited to what they need to provide their service to you.

We may also share data with our professional advisors (legal, accounting, audit) where necessary, and with authorities where we are legally obliged to do so.

We do not sell personal data, and we do not share it with third parties for their own marketing purposes.

 

Where your data is processed, international transfers

Kings Avenue is based in Switzerland, a country recognised by the European Commission as providing an adequate level of data protection. Data may also be processed within the EU/EEA.

Some of our service providers (for example Google and Intuit Mailchimp) are based in the United States. Where personal data is transferred to the US or another country without an adequate level of data protection, we rely on appropriate safeguards, in particular certification under the EU–U.S. Data Privacy Framework (and its Swiss–U.S. extension) or the European Commission’s Standard Contractual Clauses.

 

How long we store personal data

We do not store your personal data longer than necessary for the purposes for which it was collected, and in any case within the following retention framework:

  • Enquiry data (no booking concluded): up to 2 years after our last contact, so that we can assist you properly if you return to us
  • Client and booking data: for the duration of our client relationship and thereafter for 10 years, in line with Swiss commercial record-keeping and limitation periods
  • Identity documents (passport copies): for the duration of the contract and applicable legal retention periods, stored securely with restricted access
  • Newsletter data: until you unsubscribe
  • Website / cookie data: according to the lifespan of the individual cookie (see our cookie banner for details)

 

How we protect your data

We have taken appropriate technical and organisational measures to protect your personal data against loss, misuse and unlawful processing, including access controls, secure systems, and confidentiality obligations for everyone working with us. Only authorised persons may access and process your data.

 

Cookies

Our website uses cookies and similar technologies.

  • Necessary cookies are required for the technical operation of the website and are always active.
  • Analytics and advertising cookies (Google Analytics, Google Ads) are only placed with your consent, which you give or refuse via the cookie banner when you first visit our website.

You can change or withdraw your cookie choices at any time via the cookie settings on our website, and you can delete cookies via your browser settings at any time.

 

Your rights

You have the following rights regarding your personal data:

  • Access — to know what personal data we process about you and to receive a copy
  • Rectification — to have incorrect data corrected
  • Erasure (“right to be forgotten”) — to have your data deleted where there is no longer a lawful reason to keep it
  • Restriction of processing — to limit how we use your data in certain situations
  • Objection — to object to processing based on our legitimate interests, and at any time to processing for direct marketing
  • Data portability — to receive the data you have provided to us in a common electronic format
  • Withdrawal of consent — where processing is based on consent, you may withdraw it at any time, without affecting the lawfulness of processing before withdrawal

To exercise any of these rights, please contact us at info@kingsavenue.com. To protect your privacy, we may ask you to verify your identity before we release information. We will respond as quickly as possible, and at the latest within 30 days.

You also have the right to lodge a complaint with a supervisory authority: in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch); in the EU, the data protection authority of your country of residence.

 

Changes to this privacy policy

We may amend this privacy policy from time to time, for example when our business activities, the services we use, or the law change. The current version is always available on this page.
